Organizational Conflict of interest

Organizational conflict of interest (OCOI) describes situations in which an organization, institution, agency, or individual may have access to information or other resources giving an unfair advantage in what should be a competitive opportunity, per 2 CFR 200.318 General Procurement StandardsFederal Acquisitions Regulations (FARs) 9.5, and DOE COI, COC, and OCOI Regulation.

OCOI concerns are most likely to arise in opportunities for competitive federal contracts, agreements, support or advice, as well as purchasing for System and its members. System Research Compliance Office review for OCOI is a requirement of many such applications.

Items related to OCOI include:

  • accessing non-publicly available information, relationships, or resources
  • participating in RFP development, project or submission evaluation
  • maintaining financial relations with the vendor/sponsor
  • DOE Specific – engaging in a procurement or other transaction to acquire services or property, using DOE funds with a parent, affiliate, or subsidiary organization that is not a State government, local government, or Indian Tribe
