Tort Incident Reporting<\/strong><\/h1>

Tort Incident Reporting \u2013 Bodily Injury\/Property Damage to Non-Employees (Third Parties)<\/strong><\/p>

The Texas A&M University System Risk Management and Safety Office (RMS) and the Office of General Counsel (OGC) requires immediate notice of any possible claim that may arise under the Texas Tort Claims Act (Chapter 101, Texas Civil Practice and Remedies Code).<\/p>

All incidents must be reported by completing an Incident Form<\/strong> and submitting a new incident in our claim system, Origami.\u00a0There are two related Incident Forms, one for Member (Department)<\/strong> completion and one for the Third-Party<\/strong> completion. At minimum, the Member (Department) must complete the Member Incident Form with necessary details of the incident. \u00a0<\/p>

When submitting the incident in Origami or completing the incident report form, please include as many details as possible. This should be done immediately upon the occurrence of any incident that may be considered a possible claim under the Texas Tort Claims Act. Upload photos, emails, police reports, maintenance reports, etc. into the Origami incident. The incident should be submitted no later than five days after the essential details of the incident are known.<\/p>

Reporting procedures should be established within each System Member so that the chief financial officer or a designee will be made aware immediately of any such incidents and with sufficient details thereon required to prepare and promptly submit the incident.<\/strong><\/p>

Member should indicate whether the third party has made a request for compensation or if the report is for record only.
