{"id":12304,"date":"2014-05-28T13:13:40","date_gmt":"2014-05-28T13:13:40","guid":{"rendered":"http:\/\/www2.tamus.org\/system\/system-offices\/general-counsel\/practice-areas\/property-construction\/"},"modified":"2025-10-06T13:08:39","modified_gmt":"2025-10-06T18:08:39","slug":"property-construction","status":"publish","type":"page","link":"https:\/\/www.tamus.edu\/legal\/practice-areas\/property-construction\/","title":{"rendered":"Property &amp; Construction"},"content":{"rendered":"\n<h1 style=\"position:absolute;width:1px;height:1px;padding:0;margin:-1px;overflow:hidden;clip:rect(0,0,0,0);border:0;white-space:nowrap;\">\n  Property &#038; Construction\n<\/h1>\n\n\n<p style=\"text-align: justify;\">The Property &amp; Construction (\u201cP&amp;C\u201d) Section of the Office of General Counsel (\u201cOGC\u201d) of The Texas A&amp;M University System (\u201cA&amp;M System\u201d) provides centralized and comprehensive services in the areas of real estate, oil &amp; gas, gifts\/donations &amp; bequests, and facilities planning and construction.<\/p>\n<p style=\"font-weight: 400;\"><strong>SYSTEM LAND MANAGEMENT OFFICE, a function of Business Affairs<br \/><\/strong>The System Land Management Office (\u201cLMO\u201d) provides oversight control of A&amp;M System\u2019s energy related real property assets, to include mineral holdings as well as related surface and subsurface easements and rights-of-way, and corresponding seismic and reservoir data, for the Board of Regents and the respective A&amp;M System members in accordance with\u00a0<a href=\"https:\/\/policies.tamus.edu\/41-01-01.pdf\">System Regulation 41.01.01<\/a>. For more information and contact information for the LMO, please click\u00a0<a href=\"https:\/\/www.tamus.edu\/business\/land\/\">here<\/a>.<\/p>\n<p style=\"text-align: justify;\"><strong>SYSTEM REAL ESTATE OFFICE, a function of Business Affairs<\/strong><b><br \/><\/b>All activities involving the acquisition, disposition, and lease of real property and real property interests, with a few exceptions, are consolidated in the System Real Estate Office (\u201cSREO\u201d) and coordinated with the appropriate A&amp;M System Member or Members in accordance with <a href=\"https:\/\/policies.tamus.edu\/41-01-01.pdf\">System Regulation 41.01.01<\/a>.\u00a0 As such, Members should initiate most real estate matters with a Real Estate Specialist in the SREO (with the exception of oil, gas, mineral, and easement matters which should be initiated with the Landman in the System Energy Resource Office). The SREO works closely with the attorneys in the P&amp;C Section of the OGC to assist Members with their real estate issues. For more information and contact information for the SREO, please click <a href=\"https:\/\/www.tamus.edu\/business\/real-estate\/\">here<\/a>.<\/p>\n<p style=\"font-weight: 400;\"><strong>RATE AND FEE SCHEDULE<br \/><\/strong>Under the direction of Business Affairs, SREO administers surface assets and LMO administers mineral assets and right-of-way improvements located on A&amp;M System real property (the \u201cProperty\u201d).<\/p>\n<p style=\"font-weight: 400;\">In furtherance of their mandate, SREO &amp; LMO have published a Rate &amp; Fee Schedule (the \u201cSchedule\u201d) to provide guidelines for the assessment of rates and fees associated with the use of the Property by a third-party entity (\u201cRequestor\u201d). The Schedule is intended to serve as an aid to Requestor that is considering engaging in operations of any kind (the \u201cOperations\u201d) on the Property.\u00a0 The Schedule should assist Requestor in estimating Requestor\u2019s minimum financial exposure to rates and fees associated with the Operations on the Property and to establish certain administrative guidelines which may govern the Operations.\u00a0 Click\u00a0<a href=\"https:\/\/www.tamus.edu\/legal\/wp-content\/uploads\/sites\/26\/2022\/02\/RateFeeSchedule_2021_FinalDraft_APPROVED-3.pdf\">here<\/a>\u00a0to access the Schedule.<\/p>\n<p style=\"text-align: justify;\"><b>DOCUMENT DRAFTING, REVIEW &amp; APPROVAL PROCESS<br \/><\/b>The attorneys in the P&amp;C Section are responsible for drafting, reviewing, and approving real estate documents as required by\u00a0<a href=\"https:\/\/policies.tamus.edu\/41-01.pdf\">System Policy 41.01<\/a>\u00a0and\u00a0<a href=\"https:\/\/policies.tamus.edu\/41-01-01.pdf\">System Regulation 41.01.01<\/a>.<b>\u00a0\u00a0<\/b>After Members initiate a real estate matter with the Landman in LMO or the Real Estate Analyst in SREO, as applicable, the file is then assigned to an attorney in the P&amp;C Section. Together LMO, SREO and the P&amp;C Section work to address our Members\u2019 real estate needs.<\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"color: #333333;\">REAL ESTATE &amp; OIL AND GAS<\/span><\/strong><b><span style=\"color: #333333;\"><br \/><\/span><\/b>The P&amp;C Section of OGC handles all real property acquisitions, sales, leases, licenses\/permits, easements, mineral leases, and other real estate matters for the A&amp;M System. The services include negotiation, preparation, and review of documents.
