The Health Law Section provides legal advice and counsel to all colleges, centers and institutes of the Texas A&M Health Science Center (“TAMHSC”) and to the nursing colleges and allied health enterprises of other member institutions regarding healthcare transactional, regulatory, and operational matters. The section also monitors and advises regarding practitioner licensing matters before the Texas Medical Board and Texas State Board of Dental Examiners.
The section reviews and responds to healthcare incidents and liability claims and manages litigation relating to the care and treatment of patients by TAMHSC physicians, dentists and other healthcare providers. Management of claims and litigation includes legal review and investigation of medical/dental liability claims, negotiation of settlements, defense of lawsuits, management of outside counsel, and coordination with the Office of the Attorney General. The section also proactively participates in risk management consultations and presentations with the aim of reducing the risk of involvement in incidents and allegations of medical negligence.
PRIVACY OF INFORMATION AND HIPAA
Protecting the privacy of patient, employee and student information is of paramount importance to The Texas A&M University System and its member institutions. The Health Law Section provides counsel regarding the policies, procedures and practices needed to safeguard the privacy of confidential health information entrusted to TAMHSC and other member institutions, including compliance with the Health Insurance Portability and Accountability Act of 1996 and HB 300.
EXPANSION OF RESEARCH, CLINICAL OR EDUCATIONAL ENTERPRISE
The section consults with TAMHSC leadership regarding proposals or opportunities to expand the research, clinical or educational enterprise through affiliation or collaboration agreements, professional service agreements, research agreements, or other operational agreements that will establish mutually beneficial relationships and generate funding necessary to support operations. Further, this section works with TAMHSC’s Office of Technology Translation to expand commercialization opportunities that benefit TAMHSC’s researchers.
TEXAS A&M CENTER FOR INNOVATION IN ADVANCED DEVELOPMENT & MANUFACTURING
This section supports the Texas A&M CIADM and provides advice regarding U.S. government regulations, including Federal Acquisition Regulations and Cost Accounting Standards, and all applicable Federal, state, municipal and local laws, rules, regulations and requirements to ensure compliance with its contractual obligations.
